Coach terms of service

Welcome to Fettle, a coaching platform available at stayfettle.com. These terms of service form a legal agreement between you (the coach) and Verity AI Ltd, a company registered in England and Wales. You can contact us at hello@stayfettle.com.
By creating an account and using Fettle, you agree to these terms.
1. The service and your licence Verity AI Ltd grants you a limited, non-exclusive, non-transferable licence to use the Fettle platform to manage your coaching clients. We provide the software as a service. We reserve all other rights to the Fettle platform, its code, and its branding.
2. Subscriptions and free trial We offer a full-month free trial for new coaches. Following the trial, access to the platform requires a flat monthly subscription. Please note that we are currently operating on proposed pricing and are not yet charging subscription fees. We will notify you in advance when we begin charging and you will have the opportunity to cancel before any payment is taken.
3. Acceptable use You must use Fettle only for its intended purpose of managing your coaching business. You agree not to misuse the platform. This includes not attempting to hack, disrupt, or copy the service, and not using the platform to store or transmit illegal, malicious, or abusive material.
4. Your responsibilities to your clients You are entirely responsible for the coaching services you provide. When using Fettle to process your clients' data, you must:
- Obtain explicit consent from your clients to process their health and fitness data, which is classed as special-category data under data protection law.
- Ensure your clients know that they can revoke this consent at any time.
- Provide your coaching services lawfully and in compliance with all applicable regulations.
- Protect your clients' privacy and not misuse their personal data.
5. Data protection and roles Under data protection law, you are the Data Controller for the personal, health, and fitness data of your clients. Verity AI Ltd acts as your Data Processor. We process your clients' data only on your documented instructions. The specific terms governing this relationship are set out in our Data Processing Agreement, which is incorporated into these terms by reference.
Verity AI Ltd acts as a Data Controller only for its own business purposes. This includes your account information, billing details processed via Stripe, and platform analytics data.
6. No medical advice and disclaimer of warranties Fettle is a software tool, not a medical or healthcare provider. We do not provide medical advice, diagnosis, or treatment. You remain solely responsible for the coaching, nutritional, and fitness advice you provide to your clients. The platform is provided "as is" and we make no guarantees that it will be completely error-free or uninterrupted.
7. Limitation of liability To the maximum extent permitted by law, Verity AI Ltd shall not be liable for any indirect, incidental, or consequential losses, nor for any loss of profit, revenue, or data arising out of your use of the platform. Our total liability to you for any claim arising from these terms shall be limited to the total subscription fees you have paid to us in the twelve months preceding the claim. Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud.
8. Suspension and termination You may terminate this agreement at any time by closing your account and ceasing to use the service. We may suspend or terminate your access to Fettle immediately if you breach these terms. Upon termination, your right to use the platform will end, and client data will be handled in accordance with the Data Processing Agreement.
9. Governing law and jurisdiction These terms are governed by the laws of England and Wales. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
